Decision No 35 of Moldova's National Extraordinary Public Health Commission from 27 November 2020

Chisinau, 27 November /MOLDPRES/ - Under the Article 58 from the Law No 10/2009 on the state supervision of the public health sector (Official Journal, 2009, No 67, Article 183), with the subsequent amendments, at a proposal by the director of the National Public Health Agency (ANSP)

taking into account that the assessment of the indicators of the level of risk of transmission of the SARS-CoV-2 virus shows the need of maintaining a comprehensive answer to the epidemiological situation, triggered by the spread of the new-type coronavirus,

proceeding from the nation-wide evolution of the epidemiological situation till 27 November 2020, taking into consideration, in particular, the increase in the number of people infected nationally, as well as the daily increase in the number of newly confirmed cases, adverse implementation of the preventive measures, intense interaction and mobility of people, aspects which trigger a constant pressure on the capacity of management of administrative and territorial units and of the medical system,    

taking into account that the Red Code alert level is established in all administrative and territorial units,

The National Extraordinary Public Health Commission (CNESP) finds out that the epidemiological situation all over the country is alarmingly worsening.

To enhance the measures enforced to prevent and control the COVID-19 infection, CNESP  

DECIDES:

1. To declare the emergency state in the public health sector all over Moldova on the period 30 November 2020 – 15 January 2021.

2. To maintain the mechanism of management of the epidemiological situation, in accordance with the plan on preparation and response to the infection with the new-type coronavirus (COVID-19) – Version 2, approved under the CNESP Decision No 30 from 11 September 2020.  

3. The indicators of the level of risk of transmission of the SARS-CoV-2 virus, established in the aforementioned Plan, will be calculated by the National Public Health Agency once in 14 days and will be presented to the National Extraordinary Public Health Commission for updating the decisions.    

4. To set the measures of prevention and control of the COVID-19 infection, applicable nationally, according to the annex.

5. To ban, starting from 28 November 2020, the work of the night clubs, which refer to the activity of discotheques included in the code CAEM 56.30 and the dance rings included in the code CAEM 93.29, no matter the firm name of the commercial unit (for instance, disco-pub, night club, karaoke, discotheque, pub, etc.).

6. To prohibit the work of service in the public nourishment units (of the types of restaurants, pubs, canteens, coffee houses) in the time interval 22:00-7:00.

7. To ban the organization and holding of scientific conferences, sports competitions, Olympiads, with people’s physical presence.  

8. To prohibit the carrying out of activities with the presence of audience at theatres, movie theatres, concert halls, community centres.

9. The heads of the public and private institutions are instructed to establish a flexible or special working regime, with the attraction to work of the strictly necessary staff, in order to ensure the institution’s functionality and the personnel whose activity needs the compulsory presence at the work place. The distance work must be ensured for the staff whose activity does not need the compulsory presence at the working place. During the carrying out of the work from home, the employees fulfill the duties specific for the position they hold. The employer has right to verify the work of the employee who works from home. The concrete way of carrying out the control will be accepted mutually by means of electronic communication.    

10. The authorities of the public order sector should continue supervising the observance by private people and legal entities of the measures of prevention and control of the COVID-19 infection.   

11. The decisions of the National Extraordinary Public Health Commission are executory for the central and local public administration authorities, for private people and legal entities, no matter the activity sector and the legal form of organization.  

12. The territorial extraordinary public health commissions will ensure the revising of all decisions/instructions approved, bringing them in line with the decisions by the National Extraordinary Public Health Commission of Moldova.

13. CNESP recommends that media representatives inform the public about the need to strictly observe the measures of prevention and control of the COVID-19 infection.  

14. The non-observance of the public health measures, set forth in the present Decision, represents danger for the public health and will serve as reason for calling the guilty people to contravention/criminal account. 

15. The present decision enters into force on 30 November 2020 and is published on the Government’s official webpage.
